1. Acceptance of Terms

By accessing or using GymForge ("Service"), operated by GymForge LLC ("Company," "we," "us"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the Service.

2. Description of Service

GymForge provides gym and martial arts school management software, including:

• Member management
• Membership plan management
• Rank/belt tracking

We reserve the right to modify or discontinue any part of the Service at any time.

3. Eligibility

You must be at least 18 years old to use the Service. If you are using GymForge on behalf of a business, you represent that you have authority to bind that entity.

4. Account Responsibilities

You agree to:

• Provide accurate information
• Maintain security of your login credentials
• Notify us immediately of unauthorized access

You are responsible for all activity under your account.

5. Payments & Subscriptions

• GymForge is offered as a subscription service at the pricing stated during signup, early access onboarding, or a written agreement
• Payments are billed in advance and are non-refundable unless required by law
• You may cancel anytime; access continues through the billing period
• We may change pricing with reasonable notice

Failure to pay may result in suspension or termination.

6. Customer Data

You retain ownership of all data you input ("Customer Data"), including:

• Member information
• Payment records
• Contact details
• Minor/child data (if applicable)

You grant GymForge a limited license to store, process, and display your Customer Data solely to provide the Service.

You are responsible for:

• Obtaining consent from your members
• Complying with all applicable laws (including privacy laws and minor protection laws)

7. Sensitive Data Disclaimer

GymForge may store sensitive personal information. We implement reasonable safeguards, but we do not guarantee absolute security.

You agree not to store:

• Social Security numbers
• Government IDs
• Medical records (unless explicitly supported and compliant)

8. Prohibited Use

You may not:

• Use the Service for illegal purposes
• Attempt to hack, reverse engineer, or disrupt
• Upload malicious code
• Use the platform to harass or exploit others

9. Data Processing & Third Parties

We may use third-party providers (e.g., payment processors like Stripe) to operate the Service. These providers may process your data under their own terms.

10. Termination

We may suspend or terminate your account if:

• You violate these Terms
• You fail to pay
• Your use poses risk to the platform

You may terminate at any time.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available." We do not guarantee:

• No downtime
• Error-free operation
• Fitness for a particular purpose

12. Limitation of Liability

To the maximum extent allowed by law, GymForge shall not be liable for:

• Lost revenue
• Data loss
• Business interruption
• Indirect or consequential damages

Total liability is limited to the amount you paid in the last 12 months.

13. Indemnification

You agree to indemnify GymForge from claims arising out of:

• Your use of the Service
• Your violation of laws
• Your handling of customer data

14. Governing Law

These Terms are governed by the laws of the State of California.

15. Changes to Terms

We may update these Terms. Continued use of the Service constitutes acceptance of the updated Terms.
